Because that is how these court cases usually get started, the same as Powley in Ontario. An aboriginal person gets charged, it goes to court. Being charged DOES NOT mean guilty! And your way off base on the Federal Govt being limited to Powley....do a little more research will ya? Like I said, you really don't know much about this issue so why spread more disingeneious information???
