If you consider an unsuccessful hunt to be a waste of time,

One would think that a hunting publication wouldn't use the term 'hunting' for illegal activity; "regularly gun hunted non-game migratory birds,". Animals shot outside of the law have been 'poached', not 'gun hunted'.
