Default Question About Procedures When Employer Owes Money

In a bit of a situation right now.

My current employer told us all he cannot afford to pay us, yet he is in the bars almost every night getting trashed and also alot going up his nose.

I am still working for him but just waiting for some call backs so I can get the heck out of this place. I do have a family to support. I am also not the only employee in this situation with him. Everyone is trying to find another job asap but what is the process to get my wages owed to me? He is one full payday behind already.

Is the labour board the place that would deal with this?

Very frustrating

Actually I have been in this situation and still am come to think of it.

But in my case the Alberta Government was the one owing me, in which case there is no recourse. And by now I'm sure the statute of limitation would protect them.

If the company goes into bankruptcy the Wage Earners Protection Program can get you to the front of the line in the process. I got some money from that before but you’re at the mercy of the receivership process so chances are it will be 6 months minimum before you see anything presuming it hasn’t gone up his nose in the intervening time.

I am definitely moving on soon, actually going to a interview tomorrow.

The guy has money, work is slow and on payday he tells everyone he cannot afford to pay us right now. If you saw the things hes been buying it may explain why hes broke. I know he has money coming in as I know how customers do billing/paying to contractors like us. Hes not fooling anyone.

Either way its a no

Wish I new what I was getting into when I started. It is the kind of place where my wife's coworkers asked where I worked and she told them, immediate looks of disgust and comments like *oh, for that guy* then advice on how she should tell me to get out and be carful lol.

Just trying to prepare myself for when I give notice etc. I want to do things right even though this guy does NOT deserve it. Our area has been hit hard with job losses and will be getting work come January. Heading out of town tomorrow for some interviews.

I have seen how my boss reacts when people quit even though he treats them like garbage and owes everyone money. He has the "screw you, your not getting anything" attitude

From what I have heard an ex employee has a case against him for wrongful dismissal. I saw the evidence as I met the guy and it is a solid case.

I’ve been in this situation before. At this point your time is better spent looking for new work rather than working for free. Hopefully your interviews go well.

Luckily when this happened to me I had a full set of company keys so I took home enough tools that I could pawn if I never got a paycheque. I called my boss and told him I was done and I’d expect my paycheque that Friday if he wanted his tools back. I got my cheque, nobody else in the company did as far as I know. I gave all the tools back and raced to the bank to cash that cheque before it bounced.
