Loaded gun on a vehicle
Ok,, I know we’ve been through this before.
Having a loaded gun on a vehicle or shooting from one for target practice...
Legal or not? Where is the law that states this. I’ve looked at the hunting regulations and it spells it out specifically but... on a different forum I’m being told that it “only applies to hunting situations” not target shooting.
Does anyone know if there is a difference between hunting or target shooting?
Where in the firearms act does it spell it out?

The Wildlife Act applies whether you are hunting or not. That is also why you can only discharge a firearm at night , at an approved range.

Revised Statutes of Alberta 2000 Chapter W-10 Current as of December 17, 2014
The wording in the Alberta Wildlife Act clearly states it is not legal to have a loaded firearm on or in a vehicle :
Quote:
Use of vehicles, boats and aircraft
33(1) A person shall not
(a) hunt wildlife from or with an aircraft,
(b) use a vehicle, aircraft or boat with intent to harass, injure
or kill wildlife,
(c) discharge a weapon from a vehicle, aircraft or boat, other
than a boat that is propelled by muscular power or
anchored, or
(d) have a loaded firearm on or in a vehicle, aircraft or boat,
other than a boat so propelled or anchored.

Where does it state that the Wildlife Act only applies while hunting? And there is no exemption listed for target shooting, so it applies while target shooting.

It doesn't, but it doesn't have to. Government Acts are applicable for all actions. There isn't a Hunting Act, Taget Shooting Act, Plinking Act, Shooting Into the Air Celebrating Act, Training Act, etc.

A lot of things happen that aren't legal, but the fact that they happen, doesn't make them legal.

The activity of “discharging or having a loaded firearm in or on a motor vehicle”
Is the prescribed activity...regardless of whether you are hunting or target shooting or transporting a firearm.

I agree. It was an observation, not an indictment or an excuse.

I think that dedicated "sport shooters", who don't hunt, would be hard pressed to ever know about a "shooting law" that only exists in the Provincial Hunting Regulations. Why would they ever look there to find out if it's legal to shoot at paper/steel targets from the bed of their truck ?
Just sayin...

Good point. So, where would a dedicated sport shooter, who doesn't hunt, find and verify the Provincial laws in regards to firearms use within the province?
Just askin...

Well, in the old days people called the local station and asked or in today's age we use the Google.
Ignorance of the law is not an excuse they often accept in court so like all things where there is some inherent danger we need to be adults and look into it.
That said, if it isn't bothering anybody its unlikely anyone will come and look.

That’s my point, even thought I understand it to be illegal, I can’t find the statute that says that it is.

So without a " Sport Shooting Act" how do you know that you you can't legally go out and target shoot on private property without permission? How do you know that it's illegal to have a few beer while you are shooting ? How do you know that you can't legally leave your garbage behind after you are done shooting? It is your responsibility to know the laws, regardless of which Act they are located in.

I’d go out on a limb here and say everyone on this forum has done something illegal at one point!

To me, considering how hazardous it is, why not just haul your butt out of the vehicle? Target practice...I can’t think of a more inaccurate way to ‘target’ practice...IMHO.

Just a guess, but if F & W caught someone shooting using truck as rest the person could use " I was just target shooting" as a "Get out of Jail Card"
