Default snaring along railway tracks

could somebody clear up the legality of snaring along train track right of way?would you need permission from the rail road or would the owner of the surrounding lands permission be good enough?thanks for the help

Probably you are going to have to talk with the F&W people. If the said railroad is passing thru a registered line, I would think that it might be the trappers right, even though it is the RR's property. I know that the RR people, take care of their own beaver problems...SSS..
In re.reading your post, if the snaring was away from the legal rightofway, then only the landowners permission is needed and a resident licence.. Out of curiosity, why would you want to set that close to a rail line ??

I looked into trapping RR lands several years ago and found that I would have had to ask the railway formally in writing for permission and it was extremely unlikely I would get access. I didn't pursue it after.

Then I found that skidooers like to run along the railway right of way and odds are someone would have been checking my snares for me anyways. Great place for yappers to run but also high human traffic area. With all of the skidooers, rail service people, and trains... the bad part is the snow is a dead give away as to where you walked to make your sets.
