A letter to the editor, by Kate McQuarrie, of the Women Shooters of PEI, ver suitable to copy and send to any paper in Canada, and any politician;

On May 1, Justin Trudeau announced a ban of what he called “military-grade assault-style weapons”. There are many reasons why Canadians generally, and not just firearms owners, should be deeply concerned by this.

First is process. The ban was done via order-in-council, without parliamentary debate. In short, the prime minister sidestepped democratic process. Regardless of your views on firearms, surely you will agree that it is reasonable to expect that law-abiding Canadians not be arbitrarily stripped of their private property without full debate in the House of Commons.

Second is timing. Canada is in the midst of the COVID-19 pandemic, where our ability to object to this ban is severely limited. At the moment, we can’t even meet with our members of Parliament, or convene a meeting of affected gun owners to explain what the changes mean. This adds to the undemocratic nature of the ban.

Third is misrepresentation. The ban has been presented as being limited to so-called high-powered centre-fire semi-automatic rifles “designed to kill the largest number of people in the shortest amount of time” according to the prime minister. In fact, the list includes single-shot shotguns, bolt-action rifles, .22 rimfire rifles, hunting rifles and even cannons. The ban states these firearms are not suitable for use in hunting when, in fact, many of the listed firearms are commonly used for exactly that.

Lastly is efficacy. The ban is being presented as a way to reduce crime, save lives, and – in particular – address the recent tragedy in Nova Scotia. There, the killer not only did not have a gun licence, he had illegal guns and had once been prohibited from owning firearms. This ban would not have prevented what happened in Nova Scotia. It won’t reduce gang violence in big cities. It will not do one single thing to reduce crime in Canada. Because legal gun owners are not the problem.

What kind of person would want a breed of dog that is proven to bite people?

No one needs a Rottweiler to **** on your carpet when a cocker spaniel is perfectly able to do exactly the same thing.

But you say "it's not the dogs fault, it's the owners"

This may, or may not be, the final word on the shotgun bore issue, I don't have the source of the info at hand, and yet the issue presented in the Ellwood Epps vid leaves me thinking that nobody bought that gun with the intent of braking an arbitrary law written by people who did not do due diligence on their research as to what specs manufacturers actually make and how they wear over time. SAAMI Is applicable in the US, CIP applies in Europe, how different are they?

The Canadian Firearms Program (CFP) of the RCMP adheres to the Association of Firearm and Tool Mark Examiners' (AFTE) definition for bore diameter measurements. "The interior dimensions of the barrel forward of the chamber but before the choke." (Glossary of the Association of Firearm & Tool Mark Examiners by the AFTE Standardization Committee, 1st Ed. 1980).

This is reflected in the RCMP's Firearms Reference Table (FRT) which clearly states that "...in shotguns, diameter of the barrel forward of the chamber but before the choke."

The CFP also recognizes the Sporting Arms and Ammunition Manufacturers' Institute (SAAMI) standards regarding firearms and ammunition.

The SAAMI chamber specifications for 10ga and 12ga shotguns do not include chokes therefore indicating that chokes are not part of the bore. Accordingly, it is the CFP's view that, in accordance with acceptable firearms industry standards for shotguns, the bore diameter measurement is considered to be at a point after the chamber, but before the choke.

Further, in making classification assessments of firearms which are reflected in the FRT, the CFP relies on recognized industry standard measurements. With respect to 10ga and 12ga shotguns, the CFP recognizes the SAAMI standard specifications which establish that the nominal (i.e. standard) bore diameter measurements for 10ga and 12ga shotguns are below the 20mm threshold (19.69mm for 10ga, 18.42mm for 12ga).

Late Friday night the RCMP declared all 12-gauge and 10-gauge shotguns are legal “because we say so.”

Please read my assessment of Minister Blair’s similarly worded legal advice on Facebook and Twitter at the end of this article. My thoughts there apply to the RCMP’s latest as well.

Friday was not a good day for Public Safety Minister Bill Blair.

The Canadian Shooting Sports Association (CSSA) published another news release slamming the minister for his May 1, 2020, Order in Council banning over 1,500 specific makes and models of semi-automatic rifles.

On Friday morning, RCMP Technical Unit Supervisor Tim Hobbs confirmed an old Iver Johnson single-shot, fixed-choke 12-gauge shotgun with a 2 3/4” chamber would be reclassified as a Prohibited firearm.

This information was obtained via an unnamed firearm dealer who recorded a video while measuring the bore of the old shotgun before speaking to Mr. Hobbs.

Adding CBSA insult to the RCMP’s injury of the Public Safety Minister’s credibility, a 2019 Canadian Border Services Agency Memorandum (D19-13-2) defines “bore” as

“the inside of the barrel of a firearm, from the throat to the muzzle, through which the projectile travels.”

By the CBSA’s definition,” said the CSSA news release, “it may be all 12-gauge and 10-gauge shotguns – not just those with removable chokes – that are now Prohibited firearms because they [Bill Blair’s office] do not consider the forcing cone, the ‘throat’ of the barrel, which exceeds the 20 mm maximum bore diameter specified in SOR/2020-96.”

But that wasn’t even the worst part of Bill Blair’s Friday daylight nightmare.

The National Shooting Sports Foundation (NSSF) issued an alert, New Canadian Gun Ban Poses Risks for Exported American Shotguns.

Based on strict reading of the new Canadian law (SOR/2020-96, Section 95) 12-gauge shotguns are banned because with the choke tube removed the muzzle diameter is 20mm or greater (depending on the model). The new law bans any firearm with a bore of 20mm or greater.

According to Canadian law, the barrel bore is measured at the widest point through which the projectile travels, which is the muzzle on a 12-gauge shotgun. 10-gauge shotguns may also be included in the ban.

We would urge all companies to exercise caution when deciding whether to export any 12-gauge or 10-gauge shotguns to Canada at this time. It is possible that the Canadian Border Security Agency (CBSA) could impound and/or seize the shipment. If impounded, you will face thousands of dollars in fees per day based on the size of your shipment. There have been public statements by Canadian officials suggesting that 12-gauge shotguns are not banned. However, the law as written has not been changed to remove any legal ambiguity.

NSSF® is attempting to obtain legally-reliable assurances from the Canadian government as to whether 12-gauge or 10-gauge shotguns can be lawfully exported to Canada. We will continue to monitor this situation and keep members updated on further developments.

Ignorance and stupidity have consequences – a timeless principle even Public Safety Minister Bill Blair may now understand.

With each passing day, we discover more and more unintended consequences delivered by Bill Blair’s OIC.

Unfortunately, over two million licenced Canadian gun owners caught in legal limbo must now ask themselves what to believe:

a Facebook and Twitter post from the Minister two days ago?
the Order in Council he published in Canada Gazette and passed into law seven days ago?
The RCMP’s declaration last night?
That any government would put its citizens in this position is unconscionable, yet here we are.

I can’t trust a word that passes over Minister Bill Blair’s lips.

My only option (if I want to remain out of federal prison) is to believe the words the Public Safety Minister wrote and passed into law by Imperial Decree in SOR/2020-96.

Ultimately, this whole disaster will take a judicial ruling to sort out.

Until then, Minister Blair’s Facebook and Twitter decrees, along with the RCMP’s edict last night, that 12-gauge and 10-gauge shotguns are not affected by SOR/2020-96 carry zero weight with me, nor should they carry any weight with you.

I’ll pass on more about this ever-expanding fiasco as new information comes to light. We’re far from done on this, edicts from on high notwithstanding.

In the meantime, stay happy, healthy and safe until common sense returns to Canada.

Just don’t hold your breath while you wait.

An important reminder:

Tweets are not sources of law.

The RCMP posting a position on their webpage is also not a source of law.

With respect to this ban, if it's not in the OIC, and not in the Criminal Code, then it is not law.

Bill Blair and the LPC screwed up in drafting the OIC, and ended up likely banning a lot more than they meant to. Now they're trying to fix that with public statements. However, remember the Beowulf magazines? The RCMP said they were legal, until they changed their mind. Same goes for 10/22 magazines, and various other things. The RCMP saying how they intend to measure shotguns today is worthless, because they can change their mind with zero notice.

They need to fix or repeal the OIC. Until that happens, or a sufficiently high court decides the issue, there is legal uncertainty and thus legal peril here.

Here's a new twist to the 20mm plus ban, from the CSSA, definitely something I was not aware of, probably a lot of other people too;

Virtue-Signalling Over Workplace Protection: Public Safety Minister Endangers Lives of Road Crews With OIC Firearm Prohibitions

The Minister of Public Safety is supposed to keep Canadians safe, not put their lives in danger, yet Bill Blair’s fatally flawed Order in Council immediately puts the lives of road construction crews and workers in other industries at risk.

Minister Blair’s OIC reclassifies all 8-gauge industrial guns as Prohibited firearms.

The bore of an 8-gauge industrial gun is 0.835 inches or 21.2 mm – outside the government’s 20mm maximum allowed. [i]

These guns are specifically designed for use in the cement, lime, and ferro alloy industries, as well as for road construction crews to take down dangerous rocks and other hazards after blasting operations take place.

Winchester Industrial, a division of Winchester Firearms, manufactures two models of 8-gauge industrial shotguns to meet the needs of these industries: [ii]

The Ringblaster Industrial Tool, a heavy-duty shooting platform
The Western Industrial Tool, a portable alternative to the Ringblaster

Winchester Industrial Equipment was used in Canada for:
cleaning rotary kilns, waste incinerators, silo interiors, and
dropping dangerous outcroppings left behind by blasting during road construction and maintenance.

Not any more.

Now these industries must find a new way to clean these pieces of equipment, and road crews must find some other way of removing dangerous rock outcroppings left over from blasting operations.

The unintended consequences of Public Safety Minister Bill Blair’s incompetence continues to grow, as does the evidence the Liberal government didn’t talk to anyone before implementing SOR/2020-96 and their so-called “military style assault weapons” ban.

Me neither, bet there are a lot more than two of us. But, it is proof that they didn't do their due diligence on the consequences of what they dreamed up in an emotional state. And another part to the story.

Sneaky Liberal Government Bans Many Firearms by Muzzle Energy

NEW CSSA Legal Opinion opens another Pandora's Box!

May 8, 2020

OSHAWA: Public Safety Minister Bill Blair insisted, via a Twitter post, that the CSSA Legal Opinion proving he – through ignorance or incompetence – banned many 12-gauge and 10-gauge shotguns in SOR/2020-96 was wrong.

“Both 10- and 12-gauge shotguns are under the 20mm provision, and thus not subject to the prohibition. Our government is taking action to protect Canadians by banning assault-style weapons – not those used for hunting.”

Thank goodness for Twitter. Apparently it has replaced the Criminal Code.

Also included are two new categories of firearms that are newly banned.

These are characterized by the following physical attributes:
⦁ Firearms with 20 mm bore or greater.
⦁ Firearms capable of discharging a projectile with a muzzle energy greater than 10 000 joules.

Even if we accept Minister Blair’s bombast on bore diameter (we don’t), the key words of the energy limitation of 10,000 joules are:

“capable of discharging a projectile…”

READ THE NEW CSSA LEGAL OPINION: "Section 96, Capable of 10,000 Joules" written by noted firearms expert Edward L. Burlew LL.B.

On Sunday, February 9, 2020, two months before anyone knew the Canadian government would ban guns using muzzle energy limits, Reddit user Bigbore_729 used a chronograph to capture what happened when he fired a 656-grain slug from a specially modified 12-gauge shotgun.

The slug exited the barrel at 2,270 feet per second. This is 7,507 foot-pounds of energy at the muzzle, or 10,178 joules, exceeding the government’s muzzle energy ceiling.

The Order-in-Council’s criteria for its muzzle energy limit is “capable of ...”

It does not say “safely.” It does not say capable of doing it “more than once.”

⦁ This Reddit user proved a modified 12-gauge shotgun is “capable of discharging a projectile with a muzzle energy greater than 10 000 joules.”

While we strongly advise against attempting this with your 12-gauge shotgun, this video proves a 12-gauge shotgun is “capable of,” potentially turning 12-gauge shotguns into Prohibited firearms under SOR/2020-96.

This is not an isolated circumstance. Many very expensive hunting firearms - bolt actions, single shot and double rifle types - are prohibited. Some of these are fine, handmade, one-of-a-kind firearms worth many thousands of dollars and not a single semi-automatic "assault-type" weapon among them.

CSSA Executive Director, Tony Bernardo says, "Minister Blair should be ashamed of himself. His promise to Canadian rings hollow with deceit. Circumventing Parliament to steal the lawfully owned property of ordinary people is contemptible."

"The use of Order-in-Council to further the Liberals cultural annihilation of licenced firearm owners is an affront to democracy and all Canadians should be outraged." he added.

When someone screws up once we can attribute it to ignorance or incompetence. But when he screws up twice on the same issue, that sounds like intentional deception to us.

We demand Minister Bill Blair immediately rescind SOR/2020-96 until such time as he can figure out what he’s really trying to accomplish.

He clearly hasn’t done so yet, and all hunters, farmers and target shooters are paying the price for his deceit.

And these are just the beginning, we knew Blair was lying, and now comes the truth and a new black market, and a whole mess on non compliance;

Oshawa, ON – Public Safety Minister Bill Blair lied when he told Canadians his gun ban via Order in Council would not prohibit shotguns.

The RCMP’s Firearms Reference Table (FRT) now lists dozens of makes and models of bolt-action, pump-action and semi-automatic shotguns as Prohibited firearms through Part 87 of the Minister’s OIC gun ban. [i]

87. The firearms of the designs commonly known as the M16, AR-10 and AR-15 rifles and the M4 carbine, and any variants or modified versions of them…

A partial list of shotguns reclassified as Prohibited firearms by the RCMP's Canadian Firearms Program in the past 24 hours include:

Adler B210 Bolt-Action Shotgun[ii]
AlphaArms 15SA Semi-Automatic Shotgun[iii]
Axor MF-1 Semi-Automatic Shotgun[iv]
Canuck Havoc Pump-Action Shotgun[v]
Derya Arms VR90 Semi-Automatic Shotgun[vi]
Eternal FX12 Semi-Automatic Shotgun[vii]
(many more guns being added as this is written including the Canadian made Maccabee Defence rifles)

It is crystal clear that Minister Bill Blair lied to Canadians about banning shotguns.

He either lied on May 1st, 2020, during Justin Trudeau’s virtue-signalling press conference: [viii]

“I want to assure hunters and farmers and target shooters in this country that nothing that we are doing today or will do in the future is intended to interfere with this lawful, responsible and legal activity.”

Or Bill Blair lied on May 5th, on Facebook: [ix]

“Earlier today, the Canadian Shooting Sports Association issued a statement alleging that our government is banning 12 and 10 gauge shotguns. This is absolutely incorrect and we will be reaching out to them to correct their misunderstanding.”

Or he lied on Twitter that same day: [x]

“Earlier today, the @CSSA_CILA issued a statement alleging that our government is banning 12 and 10 gauge shotguns. This is absolutely incorrect and we will be reaching out to them to correct their misunderstanding.”

Or Bill Blair lied to Parliament on May 6th when he said:

“I'll repeat one more time, 10-gauge and 12-gauge shotguns are not prohibited under this order in council.” [xi]

And

“We have been very clear. This does not cover 10-gauge and 12-gauge shotguns. The police will understand that. They know how to do their jobs. I trust them.” [xii]

Or Bill Blair lied to Parliament on May 7th when he said:

“We're not banning any toys and we're not banning shotguns.”

Or Bill Blair lied to Parliament on May 14th when he said:

“…the Canadian firearms program has made it explicitly clear that 10 and 12-gauge shotguns are not included in this prohibition. All people who were concerned about that need not be concerned.”

And

“Perhaps the member did not hear when I explained that the prohibition did not include these weapons [shotguns] in any way and the clarification actually has been provided by the Canadian firearms program utilizing the widely accepted standards and it explicitly states those weapons are not prohibited.”

Any way you cut it, Bill Blair lied to Canadians.

Repeatedly, both inside and outside of Parliament.

We expect politicians to play fast and loose with the truth during press conferences.

We expect politicians to play fast and loose with the truth on social media.

The one thing we do not expect and will not tolerate is government Ministers lying to the Canadian people in the House of Commons.

Minister Blair, you’ve lied enough.

Resign.

Salvage the only shred of dignity and honour still available to you – while you still can.

Resign immediately.

Also re: OIC implementation and the FRT, this list is going around on social media as a list of "newly prohibited firearms."

That is incorrect. The firearms on this list are not necessarily prohibited. The list is simply showing the results of searching "prohibited shotgun" in the FRT. All the guns listed have prohibited VARIANTS, but the parent entries for many (as in most, we just haven't checked them all) are still unchanged and non-restricted.

The prohibited and restricted variants are prohibited due to not meeting OAL or barrel length requirements; guns that have been cut down, or put into pistol-grip stocks with short barrels, or those that can be put into bullpup stocks. The notes on each variant defines why.

BUT TO BE CLEAR THIS LIST IS BULL****. THIS IS NOT A LIST OF PROHIB GUNS.

Pretty impressed with Evan Soloman doing some homework on this. It should be used as evidence in Blair's trial, the first sentence out of his mouth was a lie, and then he continued to lie.
