It is not just the road it is the road allowance. And you can be charged with trespassing if your bullet falls on private land

Hey I don't make the law. If they can't find a legitimate reason they will hit you with something stupid. They could always try littering if your bullet lands on frumpy farmers land. Bullet or timmies cup what's the difference

The difference is that the Tim's cup is unsightly and is within the purpose and spirit of littering law. There is adequate legislation to cover the discharge of firearms.

Laugh if you will, but it's an offense to even shoot over occupied land without permission, the bullet or shot doesn't even have to land on the property, to be considered an offense.

From the Wildlife Act

Quote:
No person shall hunt any wildlife or discharge any firearm on
or over occupied land or enter on occupied land for the purpose of
doing so, without the consent of the owner or occupant of it.

Yes on private land the bullet or shot would have to land on the property to be considered trespassing.

In your opinion perhaps, but if an officer received a complaint about someone shooting over private land without permission and the officer responded to witness someone shooting ground squirrels on the property from an unmaintained road allowance, I would suspect that the officer could charge the person, and a judge would find the person guilty, even though the person never set foot on the private land.

Well of course. In this instance you are describing someone hunting on land without permission.

In post #39 you stated the bullet wouldnt not even have to land on private property to be considered tresspassing. Hogwash.

A bullet travelling through the air above private property constitutes tresspassing???

In post #39 , I referred specifically to occupied land, as you pointed out in your post.#40. I suggest that you look at the wording for the regulations concerning occupied land.
