Default Title on house change.

My wife recently passed away, Dec / 19th and the house title is in both of our names. Where does one get the title changed ? House is in Edmonton.

Sorry to hear Kim, my condolences.

A law office can do it for you, but its not cheap unfortunately.

My condolences Kim, sorry for your loss. follow the below link, way cheaper than going through a lawyer, we did it all ourselves for my mother in law when the father in law passed away.

Sorry for your loss.

Is the house in JOINT TENANCY?

If so, then you can go to the Alberta Land Titles Procedure Manual.

Look for the section on Joint Tenancy and Right of Survivorship.

There is a form that gets sworn before a Commissioner of Oaths, which has an attached Certificate of Death from the Funeral Home, which is sworn as an Exhibit.

In Edmonton, you would take that to the Brownlee Building on 103 A Ave & 97 Street, Mezzinine Level, and you will have to fill out a Document Registration Request. Check off that you want a Certified Copy of Title issued in your name after Registration.

It will go downstairs to the Registrar's Office, and it will have to be picked up from there. Takes about 10 days for turn around right now.

Been there, it's not an easy road. Lawyer did it automatically, processing her will. Some things are best left to others.

Words cannot express how I feel for your loss Kim. There is very good advice from great people on here, I'm sure you will find your answers.
prayers sent to you and your family.
The last couple years have been trying for my family, my wife was diagnosed with breast cancer and we were seconds from losing our son a year ago from a unknown to us heart condition. The stars aligned and both are still with us but there was some tough days.
There are many on here to chat with including me if you ever feel the need, just send a PM.

So sorry for your loss Kim. I to have gone through this loss. I made the title change myself, it was not a difficult process. Best of luck and my heart goes out to you.

Sorry for your loss. Is money still owed on the house? I'm asking because of insurance and pension plans. I know if my dad passes first, his plan will continue paying for a house for my mother. My mother does not have a similar plan.

Thank you all for your condolences and helpful knowledge.

I'm Going through the lawyer with this. as well as a couple other things. Same lawyer that drew up our wills so a few extra dollars won't break the bank. Just gonna make it easier.

If the title is registered as joint tenants (should say it under the registered names on title), you're looking for an "Affidavit of Surviving Joint Tenant". The Alberta Land Titles Procedure Manual (Google it) will have all the instructions and the form. No lawyer required, I did it for my grandpa. You'll need a Commissioner of Oaths though.

Joint tenants means right of survivorship.

Tenants in common means fixed shares (eg. 50/50, or other fractional ownership as specified on title). The deceased's share remains a part of the deceased's estate, and requires a Grant from the Court to administer.
