So are duke 160 not certified for some species because the company hasn't kicked the $ in to have them certified in Canada or are they on the waiting list to go through the process or did they fail certification?
I can't see them them failing a new 160 for marten.

Correct the 160's are not approved for anything. The reason why I do not know but suspect they have not been tested.

“Q: Are Duke Traps certified for use in Canada, Russia & the EU under the Agreement on International Humane Trapping Standards (AIHTS)?
A: We are pleased to report that our #120 BT, #160 BT, #220 BT and #330 BT Body Traps have been tested and certified for use in Canada, Russia & the European Union. We are continuing to make good progress with the Canadian testing authorities and will submit new items for testing regularly. The AIHTS regulatory agreement is only between Canada, Russia & the EU and does not affect trapping in the United States or other countries.”

This is very misleading info on their website. I don't see anywhere that states which species they have been certified in Canada for.

Yeah, you have to look a bit. The AIHTS approved body grip traps along with species they are approved for are identified here:
