Try and press charges if the landowner whose land you are trespassing on, parks across his gate to keep you from leaving. If you wait with him until the RCMP arrive, you will only face trespassing charges, but if you damage any of the landowner's property, or if you assault or threaten the landowner, you will face more serious charges.

wrong! so very wrong! If I block someone in on my qtr when they don't have permission they will be charged with trespassing. It has happened to my father twice. Twice police told him while on the phone to block the gate until they arrived.

Are you actually being serious? Don't ever come ask me for permission.

As a land owner, if you find someone illegally entered upon or attempting entry onto your property, you have the right to block their exit and inform the proper authorities. All a landowner really has to do to make the charges even worse is tell them that they are under a citizens arrest until the proper authorities arrive to take control.

If the trespassers cause any damage to ANYTHING while trying to leave they can be charged with willful destruction of private property, resisting arrest, trespassing and a long list of other offenses.

I have known farmers that have parked their tractors within an inch of a truck, trapping them between a large tree and the tractor. They took pictures of the truck and called the police.. The guys were poaching and took a chainsaw to the tree to get away.. They had the book thrown at them.

Good advice here Don. Maybe put up some trail cams for when you're not around if u can. Good on your hired hand for taking the pic though.

Jimmy would it be possible for you to find the legislation to back your claims up? Do lay awake at night dreaming this stuff up?

Can only initiate a citizens arrest in the event of a witnessed indictable offence! Trespassing is not such an offence! But yes they can block the exit preventing the vehicle from leaving but cannot detain the people! That would be illegal detention!
