Default Being pulled over with a restricted firearm.

Hi Folks,

I have a quick question about the transport of a firearm - specifically a restricted firearm.

First off, if everything's legal (PTT, registration) locked in an opaque case with a trigger lock etc...

If I'm pulled over due to a minor infraction (speeding, disobey sign). Should I right off the bat when the officer comes to my window inform him/her of a firearm in the vehicle, or wait if/when I'm asked?

I'm just watching an American show where someone was arrested for not immediately informing the officer of having a weapon in the car.

Just curious as I want to be prepared for such an instance.

that video was a person licenced for CCW in Ohio. You are not carrying concealed so a cased trigger locked pistol is not relevent in a routine traffic stop unless LEO asks.

X10! I have a great uncle that is an RCMP officer and I asked him the Same question, unless they ask, you don't have to have to tell them.

Don't say anything. Admit you have a gun, legal or otherwise, and the officer may decide he has reasonable and probable grounds to search. Just not worth the headache.

Why tell a cop something that is none of his business? I would never volunteer any information, even if asked quite honestly. Unless he has probable cause to search your vehicle, he can't search, and you don't need to mention it. Take the ticket, say thank you, and drive home or to the range, which is what you should have been doing carrying a restricted anyway.

Edit: if asked if you have firearms (and I have never been except when crossing a border), I would only volunteer that I am legally licensed to own, possess and transport, and if I was, it would be done legally, and no you can't search my vehicle without cause. Thanks, have a nice day.

With a grain of salt…

The police are not hired to help you. They’re hired to lay charges and issue tickets. Now with that in mind, how is informing them that you have a restricted firearm going to help you? They have no way of knowing you’re transporting, and no reason to find out.

The only thing you should, and are required by law to disclose, is the information located on your drivers license. Anything further to this can and will be used against you.

Was stopped a couple years ago with a .22 wedged between the armrest and the passenger seat. Cop says "is that a gun?" Yes. "Step out of the vehicle please". On what grounds? Am I breaking a law? "Is it loaded"? No. "Ummmm, thank you, have a nice day".
Know the laws, and know your rights. Don't let them intimidate you, but let them do their job.

I don't know about Ohio, but in Texas you have to immediately inform the officer that you have a CCW permit, even if you don't have a weapon with you.

I was pulled over for speeding 4 weeks after Mayerthorpe....I had 3 guns in the car.

The officer asked "Why the rush?"....I said well I wanted to go shoot some gophers before it gets too dark.

He asked if I had a gun in the car...I said yes...

He said what a .22?.....I said no a .223, .22-250 and a .17hmr....

That was the end of it...and he gave me a break on my ticket.

The only time I would mention I had a restricted or even a non restricted gun in the vehicle is if they asked me to leave my vehicle and sit in their's.

Really? I'd simply tell them that I have to install my trigger LOCKS, place my firearm(s) in a LOCKED trunk, and LOCK all the doors while my vehicle is unattended.

As I understand it, if the Officer wants us to open the locked handgun case during a traffic stop we should refuse as our ATT does not allow us, as registered owners, to open that case anywhere else but at home or at the range.

Don't know, however, if the Officer has the right to open the locked handgun case. Anyone care to clarify on this?

If the officer wants to check compliance, you would be justified in opening the case

I'm just watching an American show where someone was arrested for not immediately informing the officer of having a weapon in the car.

That's probably because it was used as a weapon as you state here. If you legally have a firearm in your vehicle, its no ones business but you own.

Got stopped at a road block (RCMP and F&W) a few years back with my son coming back from an unsuccessful hunt.

Two guns up front, two shotguns in the back seat, and two .22's. All in plain sight.
  • RCMP - "We're checking for seatbelts, glad you have yours on. Had anything to drink?
  • Me - "Does coffee count?" with a grin
  • RCMP - No smile, asks for license and insurance, goes back to check plate. Comes back, "Oh, where you guys hunting?"
  • Me - "We tried, but no luck".
  • RCMP - "Well, could luck next time, drive safely", hands back license and registration.

Didn't ask for registration or PAL for firearms, didn't ask if they were unloaded, didn't call F&W over to check vehicle for critters.

Now, this was in the middle of nowhere's and we were the only vehicle stopped. I was and still am surprised that they didn't check out the firearms at all. Guess we looked like the law abiding type

first off you said an American show made in the U S made for U S viewers with U S laws,
where do you live ???
I assume Canada
Canada has different laws made for Canadians
and does not mirror American laws,
so best thing is is know yer fire arm laws, that were taught to you in your fire arms course, if you cant remember them maybe take a refresher course,
and get a hold of the fire arms act and read that, that way you will and should know the laws, rules and regulations, (by saying you i mean we, all of us who are unsure of these laws and these regulations)
as ignorance is no excuse in the eye of the law, and thats how we get rail road-ed here in Canada , because we don't know what the laws are and what we can or can not do, or what we should and should not do,
that is actually a good question,
If I were a constable,I would want to be informed, of any fire arm in a vehicle,
on the other hand just out right telling one may be taken in the wrong pretence, and could and eventually will be taken as a threat to the said constable,
there for maybe it is best to keep mouth shut unless asked, then don't lie,
answer him with pure honesty, ( as honesty is the best and only policy)
